Video Poker Ban Opposition Fails

Opponents of a North Carolina law that would phase out video poker machines were dealt a near fatal blow when Judge Narley Cashwell of Wake County refused to issue a restraining order to bar removal of the machines from North Carolina companies. The ban on video poker machines will go into effect in phases, the first of which will begin this weekend. In this phase of the ban, establishments with machines must reduce the number of machines in operation to no more than two. On March 1, 2007, the second phase will occur with one allowable machine, and the third phase of zero machines begins July 1, 2007. The judge heard counsels' argument for less than half an hour before reaching a decision on the case. The basis for the ruling was that the opponents of the ban failed to prove that they would be severely and negatively impacted.
